Terms of Service
Please read these terms carefully before using the Hire Nix ATS platform. By using our services, you agree to be bound by these conditions.

1. Acceptance of Terms
Welcome to Hire Nix ATS ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our Applicant Tracking System, AI Trust Engine, embeddable widgets, and related services (collectively, the "Service").
By registering for an account, accessing the Service, or integrating our code onto your website, you are agreeing to these Terms on behalf of an organization ("Tenant" or "Customer"). If you do not agree to these Terms, you may not use the Service.
2. License and Access
Subject to your compliance with these Terms and payment of applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business recruitment purposes.
2.1 Restrictions
- You may not reverse-engineer, decompile, or disassemble any part of the Service, including the AI Trust Engine and Shadow DOM widgets.
- You may not resell, sublicense, or share your access credentials with unauthorized third parties.
- You may not use the Service to build a competitive product.
3. Candidate Data & AI Processing
Hire Nix ATS utilizes advanced Large Language Models (LLMs) to parse, score, and summarize applicant data. By using the Service, you acknowledge and agree to the following:
- Ownership: You retain all rights and ownership to the candidate data (resumes, contact info) uploaded to your isolated workspace.
- Zero Retention Policy: We transmit candidate data to third-party LLM providers (e.g., OpenAI, Anthropic) via zero-retention enterprise APIs. Candidate data is strictly used for real-time processing and is never used to train public foundational AI models.
- Bias Mitigation: While our AI Trust Engine is designed to mitigate bias by stripping demographic markers, you (the Customer) remain solely responsible for your final hiring decisions and compliance with local Equal Employment Opportunity (EEO) laws.
4. Subscriptions and Billing
The Service is billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring, periodic basis (Monthly or Annually) depending on the subscription plan you select during checkout.
Unless explicitly stated in our Refund Policy, all payments are non-refundable. If payment fails, we reserve the right to suspend your workspace access until the balance is settled. Your candidate data will be preserved in a frozen state for 30 days during a suspension.
5. User Conduct and Responsibilities
You agree not to use the Service to:
- Post fictitious, discriminatory, or illegal job requisitions.
- Send spam, unsolicited communications, or malicious software to candidates.
- Scrape candidate data from external job boards in violation of their respective Terms of Service. (Our OAuth "Delta-Sync" integrations must be used legally).
6. Termination
You may cancel your Subscription at any time through the billing dashboard. Upon cancellation, you will retain access to the Service until the end of your current billing cycle.
We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon hard deletion of your workspace, all associated data is permanently purged in compliance with GDPR.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Hire Nix ATS, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or goodwill, arising from your use of the service or any hiring decisions made using the platform.
